What is Jan Lokpal Bill?

Update on 18 Oct – I have tried to answer some commonly asked questions about this movement, and also written about what all it will take to become an Anna Hazare..

I thought it right to write a post describing what Jan Lokpal Bill is and why is it needed. To give a brief history, Lokpal Bill was first introduced in parliament in 1968. It has been brought in parliament on eight times on later occasions, but has never been passed by the parliament. It is a bill that is supposed to give powers to citizens to sue the people responsible for corruption. A similar kind of independent agency disappeared corruption from Hong Kong a few decades ago.

The government is again thinking of introducing a Lokpal Bill in parliament this year, and the National Advisory Council (NAC) chaired by Sonia Gandhi is considering it. But as it stands today, the bill is riddled with loopholes, defeating its very purpose. Social activists have remarked it to be a toothless bill and not at all acceptable. An alternative bill, the Jan Lokpal Bill has been drafted by Justice Santosh Hegde (Lokayukta of Karnataka), Prashant Bhushan and Arvind Kejriwal after series of consultations with public and social activists. This bill is supported by Kiran Bedi, Shanti Bhushan, Anna Hazare, etc.

The Dandi March 2 event and the subsequent ‘fast unto death’ by Anna Hazare from April 5 and Aug 16 were in support of this ‘Jan Lokpal Bill’. The activists have already sent the bill to the PM and all CMs but there has been no response. After the ‘fast unto death’ was announced by Anna Hazare, he was invited for talks by the PM, but the response was bad as the PM said the government has no time for corruption till May 13. This after the numerous corruption scams like the Commonwealth Games, Adarsh Society, 2G scam being uncovered in the past months.

The present system to fight corruption in India can be described in some points as below –

  1. The Anti Corruption Branch and CBI comes under the government. Despite having evidence, it is very difficult to convict people as they have to take permission from the same bosses, against whom the case has to be investigated.
  2. No corrupt officer is dismissed from the job because Central Vigilance Commission, which is supposed to dismiss corrupt officers, is only an advisory body. Whenever it advises government to dismiss any senior corrupt officer, its advice is never implemented.
  3. No action is taken against corrupt judges because permission is required from the Chief Justice of India to even register an FIR against corrupt judges
  4. The functioning of CBI and vigilance departments is secret and hence it promotes corruption.
  5. Weak and corrupt people are appointed as heads of these institutions by the government.
  6. Citizens face harassment in government offices. Sometimes they are forced to pay bribes. One can only complaint to senior officers. No action is taken on complaints because senior officers also get their cut.
  7. Nothing in law to recover ill gotten wealth. A corrupt person can come out of jail and enjoy that money.
  8. Small punishment for corruption- Punishment for corruption is minimum 6 months and maximum 7 years.

As you can see, in the present system, there is no deterrent for any public official to engage in an act of corruption. Some of the salient features of the Jan Lokpal Bill are –

  1. An institution called LOKPAL in the centre and LOKAYUKTA in each state will be set up. These institutions will completely independent of the governments, just like the Supreme Court and the Election Commission. No minister can influence their investigations.
  2. Investigation in any case will have to be completed in one year. Trial should be completed in next one year so that the corrupt officer, or politician goes to jail in two years max.
  3. The loss that a corrupt person caused to the government will be recovered at the time of conviction.
  4. If any work of any citizen is not done in prescribed time in any government office, Lokpal will impose financial penalty on guilty officers, which will be given as compensation to the complainant. So, you could approach Lokpal if your ration card or passport or voter card is not being made or if police is not registering your case or any other work is not being done in prescribed time. Lokpal will have to get it done in a month’s time.
  5. Election of Lokpal officials – What if government appoint corrupt and weak people as Lokpal members? That won’t be possible because its members will be selected by judges, citizens and constitutional authorities and not by politicians, through a completely transparent and participatory process.
  6. What if some officer in Lokpal becomes corrupt? The entire functioning of Lokpal/ Lokayukta will be completely transparent. Any complaint against any officer of Lokpal shall be investigated and the officer dismissed within two months.
  7. What will happen to existing anti-corruption agencies? CVC, departmental vigilance and anti-corruption branch of CBI will be merged into Lokpal. Lokpal will have complete powers and machinery to independently investigate and prosecute any officer, judge or politician.
  8. The punishment would be minimum 5 years and maximum of life imprisonment.

    People like Kiran Bedi to be avoided as she as IPS DGP did not put even one person behind the bars so what will she do when she has no power , she preferred not to use her power for her own benefit . Now she is just fighting to stay in lime light and doing all this …it is a request that people like her not to be off considered for as god gave them chance to stop corruption , but they did not do it.
    Do u think she did not even find one corrupt man or a police officer in her 34 years of IPS life……lets think.

It is about YOU.. and NOW… What we decide to do now, what we need is the only thing that matters.. Let us all forget our personal / political / societal opinions and stand for a common cause, a corruption free India..

    Even a Sachin alone can win match without the contributions from the remaining 10 Players..

    The key to fighting corruption in any organization is transparency.
    Every document and every case and every action in the proposed LokPal organization should be open to public examination and be easily accessible (preferably though internet).

    People and NEWS agencies should be allowed to go through the activities whenever they want.

    @Sriram – rightly said – one person cannot change things.
    Your support for Kiran Bedi and Anna Hazare are baseless unless you have spent your life (atleast after you started earning) without paying bribe ?
    Yes, one person cannot change things, but can we all decide and not pay a single bribe to anyone ? If a traffice police stops us for any offence, lets pay the formal fine instead of paying 50-100 to get away ? If we go to any Govt office, like RTO, get our things done ourselves even though it needs bit more time.
    We ourselves encourage corruption and then we only shout against it. Whats the point in strengthening the bill if none of us is going to lodge a complaint against the corrupt person. The updates in the bill to have stiffer punishment for guilty are useful only if people are going to lodge a complaint. If we ourselves are not determined to get corruption removed from society, why poor Anna Hazare has to fast ! And if ware determined to get it removed, lets stop giving bribe and then no Anna Hazare needs to fast. Remeber people are taking bribes because someone gives it to them. When there is no one to give, who will take 🙂

    why we give bribe just refuse to pay them nd instead of complaining to higher authority in the same office we should complaint in cvc or other offices
    in lokpal bill u r giving punishment of life time jail for taking bribe and only 7 yrs jail in case of rape
    why to fight against corruption now fight first for the reservation seats in addmission our govt policies are allowing less efficient persons for higher job do u think a person withabove 80% marks in not eligible for job but a person with only 50% marks in eligible becoz he belongs to reserved category just think plzzzzzzzzzz

Somebody is doing it for us….the time has for us to raise our voice against these corrupt practices by the herditary politicians of the nation….infact the punishment level should no be based on extent of corruption but based on position held in society ie if a judge is corrupt he should be given major punishment compared to a clerk. Politicians, bureaucrats if found corrupt should be dealt severely…Jai Hind…..

    I agree wit dis point dat ppl like us encourage in giving bribe… bcoz we ppl are being harassed, pressurized 2 give bribe… Our strength is our Unity, bt on other hand its our weakness too.. coz if 1 ppl breaks it.. Slowly da whole strength breaks down… So, I feel 2 make a corruption free country we have 2 first clean da dirt in our house… den we can work on not 2 make dirty again……. CLEAN THE CORRUPTED PEOPLE FIRST…..

    it good to see that people supporting anna ji. I also salute to Anna ji for their efforts for their fight. But one thing i want to ask to every one whether we are transparent in our work. We ourself are the creator of corruption body by using shortcuts in our work. What we are doing today if we went to any government organization or institutes we went there and first thing we do search of the known person or the person who will do my work from back door instead of waiting for my turn we move there with that person. We over self growing this corruption. Its human nature person in power definitely misuse its power for his own growth. Lokpal bill will work only when we change our mentality and when we do our work transparently. The things can changed with & without LOKPAL If we change over self.

    Its Not about passing a bill..its about get the black money back and distribute among poor …or for a national development ..If all our swiss money comes back ….Not even a Single person have to Pay tax for 80 year…! let me give a simple Example…how these corrupt people are transferring money.. from India to Swiss or anywhere ?

    .Operation of Swiss and Italy Banks – Why are 8 Italy banks and 4 Swiss Banks like UBS being allowed to operating here ? When no common man has accounts in these banks why are these banks being permitted to operate in our country when its a known fact that these banks come from tax havens ? The answer is obvious. They are allowed here to facilitate easy transfer of black money to tax havens from our country.

    this is only one of that….this is only one such..!

    Here is other one : Guys tell me one thing do need 1000 Rs note in our country ? what for ? In India almost 60% of populations don’t even get 20 Rs to spend in a day…its not about one bill pass…what we need to do also matters….All big note 1000, 500 notes should be reclaimed by RBI. I am with Ramdev baba and Anna hazare…please dont like things on FB just share bring awareness. every action start in mind..let unite and bring our money back… JAI HIND

    who will do the invistigation against the corrupt officer of lokpal :
    option 1:- member of lokpal :- If member of lokpal will do the invistigation then agian it will become the same current situation.Currently most of the politician are corrupt so its not a big thing that in future most of the member of lokpal will become corrupt. so for this case same situation will occur (corrupt politician never invistigate correctly same as corrupt officer never invistigate correctly).
    option 2-other agencies.

    All of us, do we know whether “jan lokpal” bill undermine the freedom of common people ? Will it make India more oppressive society ? There are so many cooked up revolution now in other parts of the world, is this India’s version ? Are the corporate oligarchs making sure of their free run in the future. India is already a country sold to the western corporate oligarchies represented by NATO.
    Why is media so active ? Dal me kucch kala hai. NATO wants reform in the political structure of India, to ensure future profit for the corporations.

    And if people without understanding what’s behind all these, come out to support this, then it’s so easy for the corporate oligarchies……..The true fighters are killed (read Bhagat Singh, Subhash Bose) or jailed (read Binayak Sen), satyagrahis are there to trick you. So fellow Indians be careful. Do not lose your freedom and make your country a police state. Read the proposed the bill, and question it, debate it, before supporting each and everything. Read it from a common person’s view, find how it can be used against any proper dissent, and against you. Without reading do not take part in the mob.

    We as Indians have enough tolerance in us to sustain corrupt political powers for decades. Did we really get freedom in 1947? Yes we were free from the British rule but are we any better off? Do we have Rabindranath Tagore’s India where the mind is without fear and the head is held high? Today I remember my dear father who lived a very simple life and worked as a clerk in Mahindra and Mahindra in the Purchase dept. He was an ordinary citizen but inspite of having to educate three children, pay high monthly bills, pay hefty lawyer’s bills for a pending lawsuit against my grandfather in Goa,managed to keep his head above water and came out clean. No we didn’t enjoy all the luxuries of life, but we were extremely happy. Never ever took a bribe and never gave one. That was the story of many young and old men those days. But somewhere the greed of some men and women disturbed the balance of the structure of our Indian society. Today its at its lowest of lows. From petty haftas to fat Swiss accounts we are only seeped in corruption. Pilots are arrested for fake marksheets, DGCA officials go scot free. Kalmadi, A Raja, Nira Radia,Sharad Pawar the names and scams just keep pouring out. But they walk freely. We should also treat these people as terrorists as they are harming our country. Anna Hazare is showing us a ray of hope. Hopefully it is what we have been waiting for. Lets join in and support him in his cause.

    hi all, Is this Jan Lok pal bill for american citizens or foreigners… All are in favour and yelling at top of their voice to implement this toothless bill which is pending since 1968, it has been presented eigth times in parliament….. We all are Culprits? We are thieves and corrupt, why we are blamming poor politicians, whom we choose with our vote after 5 years. There is no need of this bill, just implement Enforcement system which are already there in each and every department be is it judiciary, police or any other govt. department. Correct our systems and everything would be fine…. We all pays bribe to traffic police to avoid challans, ? We all pays donations to school or bribes so that our children can get admission in schools. We all pay bribes to babus to get our work done at faster pace…… We have to correct ourselves…..

    Let Anna Hazara have long sleep and even then things will not change… I am sure…..

    When Sonia Gandhi brought Manmohan Singh forward as India’s PM I was happy that finally an economist will now take over the reins of the country and we will have better civic facilities, higher growth, eradication of poverty and a better life style for all but he is a mere puppet in the hands of the Government. He has given us inflation, unemployment, hike in prices so much so that even the middle clas is unable to make both ends meet, and more poverty
    Growth is not always measured in facts and figures but in what we see around I vote that the PM and the Congress Government should step down as there are more than enough charges against them the worst being the CWG where they had led the nation to shame

    Hats off to a 70+ old man for fighting for the rights of the people of this country . This was like who will put the bell in cats neck … which is the present govt. in this case… and Mr. Anna Hazare has done it. I think the entire nation like me is in complete support to what he is demanding.We have already had enough of it and can not really effort to have these buggers around anymore.

    We support this bill. In spite of this some few more modification is required to this bill.

    1.If the crime is proved a normal Cell has to be given to the criminal.(i.e no special cells should be give. It should be c class cell)

    2. The Case should be executed in front of public. A separate TV channel ,Paper, webpage should be started for this purpose and it has to go on live. Paper should be provided with the final judge statements.

    3. Rights to information act cases should be added along with this.

    4. If a crime is proven, the corresponding person should not be eligible to contest in election nor he is eligible for any government related exemptions/jobs etc.*based on the crime.

    5. If any loss to the county is made due to the crime(i.e. like A. Raja) his property & liquid funds should be taken as government fund and use for compensating the loss for the county. Even the persons related to this cases property should be made as counties national fund.

    6.This body can interfere to any activity of the county.(i.e election process, public sector exams, Educational system ,Politicians Funds in other international bank ect ).

    We should really appreciate the old man Anna hazare why because he is fighting for the nation and future India. I would like give up my support to him who is on fast unto death. By this the Govt. of India must necessarily pass the Bill in the Parliament for the sake of the citizens of India- Kishore, Seethammapeta, VSP…….

    i liked merging of CVC, departmental vigilance and anti-corruption branch of CBI into Lokpal but i have the same question that who will punish if the lokpals become currupted? becouse as all politicians are friends and they intactly mutely support each others corruptions and scams,same could be the case with lokpals.

    and some few more modification is required to this bill.

    1.If the crime is proved a normal Cell has to be given to the criminal.(i.e no special cells should be give. It should be c class cell)

    2. The Case should be executed in front of public. A separate TV channel ,Paper, webpage should be started for this purpose and it has to go on live. Paper should be provided with the final judge statements.

    3. Rights to information act cases should be added along with this.

    4. If a crime is proven, the corresponding person should not be eligible to contest in election nor he is eligible for any government related exemptions/jobs etc.*based on the crime.

    5. If any loss to the county is made due to the crime(i.e. like A. Raja) his property & liquid funds should be taken as government fund and use for compensating the loss for the county. Even the persons related to this cases property should be made as counties national fund.

    6.This body can interfere to any activity of the county.(i.e election process, public sector exams, Educational system ,Politicians Funds in other international bank ect ).

    See the Minister resigned from the GOM immediately but the Chief Vigilance Commissioner didnot. The route cause of problem in India is High IQ servents and Low IQ controllers. We need to change the HRD deployment strategy. We must draft in
    1. only a limited IQ personnel to be taken in to man government JOBs
    2. The release of High IQ persons from the job spiral will send them to seek employment as political activists, University professors, Captains of Industry, seekers and creaters of value in society. It is a job as off now left for second third grade students who work their way up the intelectual stair and try to build and creat value in the limited capacity they have.

    Every bill or law passed in any country always talks about how things are supposed to be or how it SHALL keep the process transparent and prosecute people on time.

    This Jan Lokpal bill is no different, is it? Who can guarantee things will happen the way they are intended to happen?? This government, or any government for that matter, has corrupt people in it. And these people are just like us.. from similar backgrounds, coming out of similar education systems and voted to power by similar people.

    Nothing will change until we individually make an effort in our day to day routine lives. There is something seriously wrong with our value system.

    So yes, pass this bill. My concern right now is Anna Hazare ji’s health. But do not expect corruption to go away..

    Corruption is the way of life in India. You cannot root out corruption thru some Bill or Rule.

    It has to come from within a person. An individual should have a pure conscience and I do not see a single politician or leader in India who has that feature,. there may be a few who have intention but the system will not allow them to be NOT corrupt – Live example is Dr. Singh. He may want to be non corrupt but everyone around him is corrupt so he cannot function.

    Secondly, film starts who are participating in this rally is a cruel joke. That industry is the most corrupt industry. 90% of the money is underworld and black money in this industry. They should be ashamed of themselves to jump on to this band wagon.

    Thirdly – It takes two to TANGO. (Taali ek haath se nahi bajati hai). The people who are participating in this rally/demonstration, are they willing to say that they will never pay bribe in the future; they will go thru the system come what may.

    So who are we kidding here? Let’s all go home and live with what we have.

    All this rally demonstrations are all waste of time.

    Well, I am not expert in democracy, liberty of people or socio-political structures. So is most of us.
    It seems all of us are honest nice human beings who want real freedom for their people achieved locally to the village level. And because there is no good leader, we were looking for someone like Anna Hazare (in Indian society a Tyagi Sevak is respected by people and there is nothing wrong in it). I’m not in my 20s, and so my analytical brain kicks in before my emotion gets chance to flow.
    And thus, as a fellow citizen of India , I want to request all of you to read the bill from various perspective and discuss with others before getting carried away with the emotional mob created by Anna Hazare and the media.

    Answer the following questions –

    – Why is media (mostly controlled by West) covering this so much
    – Why the corporations coming in support of this
    – Why was Bhagat Singh or Subhash Bose were killed
    – Why Khalistan movement was started and Indira Gandhi (and with her NAM) was killed
    – Why Sanjay Gandhi and Rajeev Gandhi were killed
    – Why LTTE vanished now ?
    – Why our countries power with couple of white people ?
    – Why wikileaks are showing so much influence of West/Nato on Indian politics ?
    – Why people like Binayak Sen get jails ?

    This is not about conspiracy. In this world, nothing is what it seems (true in Physics as well – classical reality is illusion, truth is something else, beyond the perception of common people). The world geo-politics, economics etc are so much inter-twined. To understand the truth, you need to scratch the surface.

    So, my request is to read, think, debate the bill before you get carried away with your emotion.

    I may be wrong, but my guess is this –

    – in coming future, most countries will get into energy, food, and resource crisis, and it will stay for decades. Peak oil, global warming/climate change everything point to that direction.     – That way corporations can loot, steal resources from India and then sell that to where they will get the best price. It’s the extreme case of – build software cheaply in India and sell that to the developed world.
    – And in a democracy, the best way to get this change done is with people’s mob/revolution

    In Russia, and China, people came to the revolution. And then in 40/50 years what happened to those people ? Did they get their liberty ? The point is that the most suffering people want something for change, without realising what would be the effect of that change.

    So, if you can read, please read the bill, understand the risks. It’s possible there is nothing wrong in the bill. But I do not know, and you also do not know. The best way to figure would be to read, talk to more learned, intelligent people , understand the various perspectives.

    The media had a good role in this movement.but a suggestion for a comman person to approach Lokpal ………….should be done. Centres of lokpal should be in all government offices/near major police station and complain should be registered at spot. As we get a booking no for out ticket/PNR No. a Complaint no. should be given to a complainant.

    Latter in case if the case is not followed up………….she/he can update the same on net / mainly a ecomplain should be registered……………So he /she knows his status of complain.

    It is only the start of a great movement and perhaps at the right moment.
    We know from our experience that Bill / Law itself is not sufficient deterrent to any kind of corruption (e.g- dowry, under the table money deals by politicians, beurocrats and others etc). People , at least educated citizens, must gather sufficient courage to come forward and make best use of the statute when it is enacted. Unfortunately, most of the middle middle class people are indifferent to this and other social evils, even who are honest. Merging of existing anticorruption agencies mentioned in para 7 may also be cause for lot of apprehensions.
    A consistent effort should be made to increase the momentum with mass campaign for awareness of people to involve and join the movement. I am hopeful that more and more persons with good image like KIRAN BEDI will appeal to students and youth to organise forums across the country ( no politicians please) in support of the cause.

    The whole effort is in vein. As per my belief corruption is something which relates to the degradation of morality and not to the system of checks and balances. A political theory holds that power corrupts and absolute power corrupts absolutely. The Jan-lokpal bill is doing nothing but creating a new system which is going to try and set standards for first few days and gonna turn up the way other institutes have. there are reasons for the same. As per mentioned by Sumit in last points it will be a free and separate institution just like Judiciary and Election Comission. But one must remember what happened to Mr. T. N. Session, the ex-election commissioner of India. Whatever happens one must understand that constitution has given all the executive powers in the hands of President including the power to appointment. President is bound to follow the advise given by the council of ministers in exercising each and every power. This decision was taken by supreme court in the case of Samasher Singh vs. Union of India. and was a totally politically influenced decision. The fact that after Keshavanand bharati’s legendary judgement a board of 15 judges was constituted to review the decision but fortunately the Congress Govt left the power and the judges never sat for the review. Therefore it is evident from the past few incidences neither the judiciary nor the election commission was ever independent of the influence of the Ministers. The Lokpal is going to be answerable to the Hon. Constitution eventually to President who cannot act beyond the advise of the council of ministers. So what is the end game???? I know this is only complaint without suggesting any solution but i am too much inexperiance to suggest one as almost all of the eminent Judges as well as political experts are not able to find the same.

    On 8 April 2011, the Government of India accepted all demands of the Indian anti-corruption movement, but it is not 100 % success.

    VERY-VERY IMPORTANT to pass our “JAN LOKPAL BILL” in Parliament unanimously

    The government LokPAL bill was passed in Lok Sabha in 1969, but they could not pass through Rajya Sabha. They got revived in 1971, 1977, 1985, 1989, 1996, 1998, 2001, 2005 and in 2008, but they were not passed and the bills were pending.

    We know very well our law making procedure in India.

    Legislative proposals are brought before either house of the Parliament of India in the form of a bill. A bill is the draft of a legislative proposal, which, when passed by both houses of Parliament and assented to by the President, becomes an Act of Parliament.

    Hence, if any Member of Parliament and others (Politician & Bureaucrats) who opposed our “JAN LOKPAL BILL” would be seen as a person who was not interested in removing corruption from our country.

    I hope our “JAN LOKPAL BILL” to be passed unanimously from our parliament. So once again we need to come together and watch be carefully, who opposed our “JAN LOKPA BILL” in parliament.

    While the purpose of Anna Hazare and all other eminent personalities is undoubtedly good, certain questions are of utmost importancs :

    A. Creating another ‘quasi government body’ type structure shall confuse the functioning of the existing structures. For example, IF JAN LOK PAL BILL HAS MAX POWER, IT SHALL ALSO HAVE THE POWER TO CHANGE THE JUDGEMENTS OF THE SUPREME COURT. I DO NOT UNDERSTAND THIS. WHAT IS THE LOGIC BEHIND IT.

    B. As for transparency of members of Jan Lok Pal is concerned, THE ELECTION PROCESS IS QUITE TRANSPARENT AS A SYSTEM. IT HAS BEEN CORRUPTED BY PEOPLE WITH VESTED INTERESTS. WHAT IS THE ASSURANCE THAT ELECTION / SELECTION OF MEMBERS OF JAN LOK PAL BILL SHALL ALSO NOT BE CORRUPTED. Also, why not to to correct the existing system itself ?

    C. Consumer forums were created for speedy trials and disposals of consumer grievances. WITHIN FEW YEARS, DISTRICT CONSUMER REDREESAL FORUMS HAVE GOT WAITING LIST OF ONE YEAR OR MORE, STATE CONSUMER REDRESSAL FORUMS HAVE WAITING LISTS OF 2 YEARS OR MORE, AND NATIONAL CONSUMER REDRESSAL FORUM HAS A WAITING LIST OF MORE THAN 3 YEARS ! HOW SHALL ONE JAN LOK PAL, A QUASI ‘BODY GOVERNMENT’ SHALL SETTLE ALL THE CASES IT RECEIVES ? INDIA IS A BIG COUNTRY. TOTAL NO. OF CASES IN ALL COURTS, INCLUDING CONSUMER COURTS, IS MORE THAN SIX CRORES.

    There are many more ! It may therefore be more appropriate that this entire unity, and crores of other followers like me, take an active participation in elections and form a big party. Once this party, principally of really honest people, comes in power, WE ERADICATE ENTIRE BAD ELEMENTS FROM THE EXISTING SYSTEMS AND MAKE IT HONESTLY FUNCTIONAL.

    ANOTHER NEED OF CORRECTION THE EXISTING SYSTEM HAS IS TO MAKE IT MORE EFFICIENT. WHY ALL THE GOVERNMENT FUNCTIONARIES CAN NOT WORK ROUND THE CLOCK ? WHY MORE PEOPLE CAN NOT BE APPOINTED TO WORK IN SHIFTS, BE IT JUDICIAL SYSTEM, BANKS, POST OFFICES, SECRETARIATS, EVEN MINISTRIES ? WHY MORE PRIVATISATION CAN NOT BE DONE ? WHY THE GOVERNMENT SHOULD BE IN PROFITABLE BUSINESS ? AND ABOVE ALL, WHEN IT IS A KNOWN FACT THAT TAXES ARE HARDLY BEING PAID HONESTLY, WHY TAX STRUCTURE CAN NOT BE SUCH THAT TAX BURDEN IS NOT HIGH BUT THE IMPLEMENTATION IS SIMPLER ? WHY DOES THE GOVERNMENT HAS SO MANY COMPLICATED LAWS OF TAXATION ?

    I would also like to add one more thing : the department which is expected to correct all the worngs and also maintain law and order, IS SO GROSSLY UNDERPAID ! INDUSTRIAL WORKERS TODAY GET MORE THAN 15000 PER MONTH SALARY AND CAN HARDLY MAINTAIN A LOWER MIDDLE CLASS LIFE STANDARD AND ALSO FIND IT DIFFICULT TO EDUCATE THEIR CHILDREN AND SAVE SOME THING FOIR THE FUTURE. HOW THEN DO WE EXPECT THAT A POLICEMAN OF THE LOWEST LEVEL CAN EARN ONLY 8,700 AFTER ALL THE DEDUCTIONS, WORK FOR LITERALLY 24 HOURS (POLICE DEPARTMENT IS ALWAYS SUPPOSED TO BE ON DUTY, EVEN WHILE AT HOME), CAN EDUCATE HIS CHILDREN, AND ALSO MAINTAIN HIS UNIFORM AND KEEP HIS SHOES SHINING ALWAYS ? AND IF EXPECTATIONS ARE SO HIGH, ARE WE, AS A COUNTRY AND AS A SOCIETY, NOT FORCING HIM TO BE DISHONEST ?

    AND IF THE LAW ENFORCEMENT AGENCY IS FORCED TO BE DISHONEST BY THE VERY SYSTEM OF EMPLOYMENT AND REMUNERATIONS, HOW CAN THE NATION EXPECT ERADICATION OF CORRUPTION ?

    Hello, I had a look at the Janlokpal bill & here are my two cents : –

    1.) No mention of prison sentences for corrupt members of Jan Lok pal bill including the chairperson, members & the employees & confiscating any recovered wealth as a result of corruption ? Why not ?

    The bill seeks prison sentences for convicted public servants, politicians, private bodies & it seems that the court can also send a false complainant to 1 year prison sentence in case of malafide intent. However nowhere in the bill & also from what I have seen on TV, the Jan Lok pal members only mention dismissal of corrupt lokpal members/ employees within 1 month. Why the double standards? Why does it not lay down equal punishment – If they seek prison sentences for others they should hold themselves to the same standard of punishment including seizure of any ill gotten wealth.

    2) No esteemed private citizens like Mr Narayan Murthy who have volunteered their services or new members of the civic society from outside have been appointed. All the people who are already connected to the Jan Lok pal bill have self appointed themselves as members of the committee in leading positions. On TV I have heard few of the Janlok pal supporters say that they are the most competent people to handle the bill. I don’t believe there are no other competent people in India besides themselves. If they had taken 2 new people from civic society it would send a signal that they are not interested in appointing only themselves!

    3) The chairperson , members & each employees of the Jan lokpal bill should also be made to declare their assets. There is no mention of this anywhere which is surprising considering that members who drafted the JanLok pal bill are mostly ex public servants & judges themselves.

    4) Why can’t anyone sue Jan Lokpal in a court of law? Again from my knowledge ( limited & I may be wrong ), even the CBI can be sued so why is the Jan Lokpal seeking immunity – if their own workings & members & employees are transparent & honest. If their own workings & member / employees are found to be corrupt why can’t they be sued ?

    5) What is the approximate estimated cost to Indian tax payers in setting up Jan Lokpal, paying salaries & hiring new employees for creating this huge institution & army of new public servants at centre & state level ? A clause in the Janlokpal bill even mentions that :-
    This clause in the bill states :-

    “ (5) There shall be a separate fund by the name of “Lokayukta fund” in which penalties/fines imposed by the Lokayukta shall be deposited and in which 10% of the loss of Public Money detected/prevented on account of investigations by Lokayukta shall also be deposited by the Government. Disposal of such fund shall be completely at the discretion of the Lokayukta and such fund shall be used only for enhancement/upgradation/extension of the infrastructure of Lokayukta.”
    Again will there be transparency in how they spend this money, they don’t mention anything.

    6) Can the RTI be used in case of Janlokpal? The only form of transpareny the Janlokpal bill says is that we will have everything on our wesite – but it will be the Janlokpal whoo will be incharge of putting information on a website – how does that enforce transparency?

    7) Why deny for example – a traffic policeman the right to use Janlokpal if he is a victim of corruption like being asked donation to get his child admitted to a school? What authority can he go to since public servants cannot make complains to Janlokpal. Who does he approach?

    Personally I do not like the idea of Janlokpal bill in its present form. It seeks to create new public servants & bureaucracy with too much power in hands of few self appointed leaders with zero accountability to anyone. I also do not agree with diluting autonomy of existing institutions of democracy under one single institution – that is like giving them absolute power with no one to watch them – who monitors the Janlokpal ? How can the JanLokpal be above the parliament & Judiciary, it doesn’t make any sense.

    I have lived in over a dozen countries and travelled more than 140, many times to Hong Kong. I was aware of ICAC not it’s history , thank you for this information. By my experience,Singapore, Sweden, Norway , Denmark , etc are good example, where corruption is near zero. I hope the whole country citizens stands firm on strong Jan Lokpal, there are bound to be corrupt people side lining and confusing the issue. If we get this law, no one will shell corores for election. In fact there will very few candidates for election. Clean and very best will come forward for the love making a difference.

    If you look at Minister in the drafting committee there are already some question marks ( Baba Ramdev has said it all). If this time we fail to get a good Jan Lokpal then India will end up with a civil war sooner or later. We have a large population of young population, very much aware of the injustice and it is difficult to keep their emotions bottled up. Not after Anna’s fast.

    Corruption emanates from the following-

    (a) Corporate Financing to Political Parties and Elections constitute the entrance gate of corruption and hence State funding to all recognized Political Parties and compulsory Auditing of their Accounts is prerequisite to stop Political corruption.

    (b) Rules, Regulations and Decision making Process needs to be Transparent and Consistent. A Transparent system deters corruption as the conduct of civil servants is under constant scrutiny.

    (c) Accountability- Civil servants and officers in responsible positions must at all times adhere to the principles of Transparency and Consistency and be Accountable to the people they serve.

    (d)Discretionary Powers-shall always be used based on well defined criteria of Fair Play, Transparency, Consistency and in larger Public Interest.

    (e) Productivity- Delay in addressing Public complaints or grievances or work or Decision making or no decision breeds to corruption. Those responsible charged with Public works should function efficiently and promptly within reasonable Time Frame.

    (f) When benefits are large, chances of getting caught are small, and penalties when caught are light, then many people will succumb to corruption. Wide discretionary powers of administrators, poorly defined, ever changing and poorly disseminated rules and regulations make situation worse.

    After enacting Jan Lokpal Bill, Auditing on the lines of CAG on points mentioned at para (b) to (f) is a must and report of same needs to be acted upon by Jan Lokpal.

    1 govt should not use the money in the name of any man, i think u don;t understand wt i mean to say, for example all major projects and instituton names, airport names are on NEHURU OR HIS FAMILY, THEY ARE ELIMINATE FROM THE NAME LIST .

    It is really encouraging and get motivated but few questions comes in every body’s mind.
    1) There are so many laws governing to each & every departments but where do we fail in real terms “LAW ENFORCEMENT & IMPLEMENTATION”.

    2)Delay Tactis/lethargisity in all areas.

    Why it is not being implemented because the Law makers taken into ride that they can rule through out their life and later with their family members(called DINESTY RULE).

    All my countrymen friends,
    The corruption has been deep rooted in our society.The corruption basically originates from top and not from bottom.If low level employee takes the bribe then he may be prosecuted easily but if top level politician/officer takes bribe then his case being submerged by ordering the commission and eye washing the charges. In facts these Indian politicians are unlike to Britishers who at least used to be justifier to citizen against Indian bureaucrat at least. Now there is no maai baap of the victim if crime committed by any politician ,except media.In police station if we go to lodge FIR they ask money and similarly in court we go for justice ,money is being asked by peskar right infront of judge and judge pretends as if he has not seen any thing. The judge himself insist peskar to do such things because he never pays to peskar for his personal expenditure.Similar way it happens all the way in India.In way it appears the Money is only the supreme judge in India.The poor will never get right justice for want of money .
    It is thereby in my opinion , The ministers and top bureaucrats must be prosecuted with only Capital punishment for their corruption and the property earned by them must be sold and may be adjusted for fiscal deficit because this money is of the public which is paid in the form of tax . Law should be so prompt let people fear of crime.

    to overcome the colonial rule the democracy was established in india. but the democracy itself become the game of rich person . the poor people are being attracted by giving some kind of money for their vote . the democracy is no more existing in India but it is money-c racy. poor going poorness day by day rich becoming richest n richest. for politician if god himself appears and advises they will say He’s the only corrupt. politician has made the mockery on democracy. in my opinion the democracy must be reform before Jan-lookup bill implementation. in the recent state election the election commissioner has become the non effective. the casting of vote is reference by the politician gundas in the election franchise it is therefore the casting of vote must be facilitated by giving a special right additionally to caste their vote on INTERNET system/ postal voting to achieve 100% voting. if constituency does not achieve near to 100% voting the election must be render of that constituency null and void, this way up to some extent the gunda’s politician will be restricted . in the parliament session the m p’s behaves as if they are the super most power and their is no law for them right in front of speaker in sedan.
    immense precaution must be adhered while drafting reformation of bill for election. even now, the constitution also to be reformed to avoid agony amongst the people of India. this constitution is dividing the people of India on the basis of caste ( because of reservation on education /job profile) , religion and region disparity.

    Offering my whole hearted support to ANNA HAZARE’s mass movement against corruption, I wish to express some of my feelings. It is true and is generally said that corruption starts at the top.But some times it happens due to willful misleading facts also to which generally the honest falls prey. So, corruption may also start at the bottom and middle level. However, as there is still prevailing honesty ,sincerity and dedication at least among very small percentage of people in the Government owned sectors ,why can we not form a resisting force of such people empowering them to raise their voice and pin point as and when scent of bribery either at the top or at bottom level is felt or reported. The Jan Lokpal bill is the most appropriate instrument for sch provisions.

    I do agree that the concept is very good. But I have full doubt about its success.Just look at the institution of election – Theoretically any citizen can contest for a parliamentary seat. But the fact is that for a common man it is now almost impossible to win even a single seat. Political parties will certainly percolate into the lokpal in the guise of citizens. It is very difficult for a real citizen in the lokpal at the local level even to prosecute a corrupt official like a local sub inspector as he can always cause trouble and harassment later. So good peace loving people will soon keep away from such bodies leaving it to waiting political parties or other vested interests. Instead of going on building such institutions it is better to introduce effective tools like the RTI , more stress on values through education and other corrective measures. Some points in the proposed bill – like the one which pevents delay in government offices and agencies is very good

When the ostracised family of Mr. Mallikarjun H bettagi sits for Dharna at Belgaum for 927 days seeking justice and then resorts to Urulu seve on the public highway, we dont even bother to look into it. When we see a man lifting the excreta from a blocked tiolet by hand , we are not moved even by an inch. We must light the candle inside our hearts, to drive away the darkness of our corrupt heart. Let us first use this opportunity to clean up our hearts first and then show our sincerity publicly

    I support the Jan Lokpal Bill,but you r never mentioned here that,if the Chairperson of the Lokpal found corrupt then who will,investigate the charges.
    Secondly, there must be lifer punishment and if charges are grave then there must be hang till death punishment be given to the corrupt officials and the ministers or the MLAs and the MPs.
    If dozens of these corrupt people will hang,then the corruption in our country will decrease to 70 percent.

    guys i have read all your comments but would like your attention on a different platform World bank has invested morethan 14 trillion dollors in india and all has gone to the pockets of politicians and bureaucrats of india primarily to the people of congress as per the present scenario US is losing its identity and within next 4 yrs their economy will crash, to them India is place of investment and return but till now they cannot do anything of these politicians because of the poor legislation in India, so they are funding this Anna Hazzare movement. The first declaration is going to be post the completion of Jan Lok pal bill is bring our money back from US as a resultthis money will reach to the Indian Govt and then US will demand for its funding through world bank given to india and the entire money will reach to US and people of this nation will not be able to beniefit from the movement but one thing is for sure this movement is the last hope of all indians( to me its the same situation as been done by MK Gandhi on namak toro kanoon and in just few nights gandhi becam a national leader………………..though he was not a true leader

    only when “The Jan Lokpall bill” is passed India will have the real freedom and the real vision of Father of Nation come true. The Ram bhoomi, or the Gandhian state is only possible in the real sense of the tern only when this bill is passed. But just passing this bill is not enough. Education has to be ensured at all levels to the implementation. All should be taught the values of honesty, sincerity and transparency. IT is a process. Enacting this bill kick starts this process. Each and every citizen of India work for a India where there is 0% corruption, where “the heart of education is the education of the heart”, bringing back the value of Glorious traditional India.

Yes off course common man dont have any time to fight with corruption,they always go for easy way to do their work as soon as possible, corruption make only by comman man or some stupid people,who dont have time and make lot of obstracles against other person in their future. anna’s bill will work if our mind and soul will agree about this. If no body will change , then there is no need to take this action and this is total money and time waste by poor goverment. So, we (comman man) have to change and fight this protest..

    What Annaji is doing ( I have already spelled this in my previous support msgs.) is for such a great and noble cause. If this LOKPAL bill is once implemented, OUR INDIA WILL BECOME RAMA RAJYA and it is 100% true. The congress government if willing to do this because for the past 61 years they have been enjoing at the stake of common people. They have been taking undue of the votes of the common people for their own personal development. I am not for any particular political party. I was a fan of INDIRAJI and LAL BAHADUR SHASTRYJI who were from congress. At the same time I have gone against yediyurappa on whom We(all those who voted for BJP) all had full trust. Who ever comes to the seat this lokpal bill applies to that party also; In that case why this government is hesitating to implement this bill? it is just because the in this party more currupted politicians are there and if this bill is implemented all of them (99%) will go to jail. If go on saying about this currupted party there is no end. OK . Thanks for fighting for the common people. Prior to 1947, 15th Aug., somany patriots sacrificed their lives for the sake of the nation; but after that day our own brothers(I am ashamed of pronouncing this word to such a currupted persons) are exploiting the common people. The currupted politicians or government officials say without this bill also everything can be controlled. If that had been there why this situation would have been created?

    I must support Anna Hassare to implement this bill .May be the politicians not agree this because ,presently each one in the parliament is the supporters of any business groups .so this will not be a true in future .Every parties in parliament ( even ruling and opposition parties ) not allow to implement this .They play and going to cheat Anna Hasare.Better he stop his fast and make new party and go for election win and implement this rules.At least minimum qualification(degree) is needed for his party main member for the perfect implementation of his ideas ,it is my open ion.

    Ideals r all nice on paper. But what happens in reality is of paramount importance. Instead of going for another institution we could have easily achieved better results by bringing in a law which makes it mandatory for all state and central governments who present their budgets in february also to present an actual statement of how much money was spent for different developmental works and who were the contractors at the end of the financial year. Also all tenders can also be made transperent
    I wonder why one should go for another curruption prone system ?
    I am greatly puzzled by the complete silence on the more serious aspects of social and economic inequalities in our society which is killing our country.
    Hope it is time to come out of the emotional wave

    I think JANLOKPAL BILL is very good to become india free from corruption.. but do u think general people will complain about the corrupt officer (middle level ) as i think they found way to realease from it……. so at small lever for. e.g. passport, ration card not possible as nobody want to interfere in it….

    In my view if the officer is transfer within 2 year that will be better and suppose any officer from west Bengal should be posted in Kerala and officer from Gujarat should be posted in Assam may it will be better otherwise if officer from west Bengal posted in west Bengal will under the control of upper class people or bureaucrats he will also not see the problem of lower class people. What will happen if Lokayukta will be corrupt ? who will punish him or her ? it is not sure that Lokayukta will not corrupt just see we have appointed officer for RTI. I think only 1% corruption is control but we have create a new corrupt officer. I am not say that all officer is corrupt but most officer is corrupted. in department there is corruption, suppose we go 2 make a ration card we have 2 pay more money the govt. revenue, for example in pass port office, Driving license, Electrical office, land revenue endless of department. From upper level to lower level every officers are corrupted.

    I hope this Janlokpal Bill will change the country in near future.

    The immaturity of team Anna is becoming increasingly evident. Annas remarks on drunkards is simply Talibanic. Today his immediate reaction on Pawar slapping case clearly reflects that attitude and his team can not be called civil society any more. He can never be called Gandhian with such violent viewpoints.Corruptian of course is condemnable. There are lot many more effective methods to abolish corruption. Annas jan lokpal isnt the ultimate one Free and independent thinking individuals can easily visualise better models I wonder why one sould blindly follow Anna in a haste. Hero worship is infact another type of corruption the biggest sufferer of which is democracy.
